U.S. District Court Judge John W. Sedwick today granted Lambda Legal’s request for a preliminary injunction blocking the elimination of domestic partner benefits for gay and lesbian Arizona State employees. The judge also substantially denied a motion to dismiss the case by State’s Attorney Charles Grube, ordering that the case proceed on the merits. Lambda Legal represents ten state employees—including from the Arizona Highway Patrol, the State Department of Game and Fish, and state universities—who rely on health benefits from their employers to safeguard their families’ health, as heterosexual workers do.
Sedwick’s ruling rejects claims by the state that the elimination of benefits will not harm the families of gay and lesbian employees because they may still be able to obtain insurance privately, through Medicaid or via the employers of the non-public employee partner. “Even assuming that is true,” Sedwick writes, citing a 9th Circuit Court ruling in Lambda Legal’s ongoing case In re Golinski, “the Ninth Circuit has recognized there is ‘an inherent inequality‘ in allowing some employees to participate fully in the State’s health plan, while expecting other employees to rely on other sources, such as private insurance or Medicaid. This ‘back of the bus‘ treatment relegates plaintiffs to a second-class status by imposing inferior workplace treatment on them, inflicting serious constitutional and dignitary harms that after-the-fact damages cannot adequately address.” [ ... ]
Sedwick also rejected the State’s claims that maintaining the same benefits for gay employees that their heterosexual co-workers will continue to receive would endanger other state services: “The State’s argument, which is not supported by any evidence, is speculative at best and discriminatory at worst. Contrary to the State’s suggestion, it is not equitable to lay the burden of the State’s budgetary shortfall on homosexual employees, any more than on any other distinct class, such as employees with green eyes or red hair.”

A 43-year-old former youth pastor at Calvary Chapel church in Longview has admitted to having sex repeatedly with a teenage girl between 2008 and last month, according to court documents filed by Kelso police. Michael Louis Anthony reported himself to Kelso police April 13 and was booked into jail Friday.
During a routine patrol, Longview police officer Ken Hardy found Anthony and the girl inside a van parked at Gerhart Gardens on Feb. 25, the police report said. Anthony’s shirt was off and the girl’s shirt was “half way up,” but Hardy “could not determine (whether) a crime occurred,” the report said. The girl told Hardy that Anthony was her youth pastor, the police report said.

Fredrich declined to comment on the situation Tuesday, saying Anthony “hasn’t been to our church in, like, seven months.”

Comedy Central has drawn some flak for censoring an episode of South Park in reaction to a murderous threat by an IslamoFascist gang of thugs in, of all places, New York City. As Jon Stewart points out: “These numbnuts get to enjoy it. All because of how much we, in this country, value and protect even their freedom of expression.”

They hate us for our freedoms, but they’re happy to avail themselves of those freedoms to praise the cowardly 9/11 terrorist hijackers and the rest of their terrorist buds around the world. Revolution Islam’s Abu Talhah Al-Amrikee, AKA Zachary Adam Chesser, posted the following death threat against the creators of the animated television series South Park:

We have to warn Matt and Trey that what they are doing is stupid, and they will probably wind up like Theo van Gogh for airing this show. This is not a threat, but a warning of the reality of what will likely happen to them.

Comedy Central is taking heat for its preemptive censorship. OK. The highlight of this little exercise in public chest beating had to be conserva-bot Ryan Sorba’s bit of gay-bashing from the podium (at 2:20 in the video above) that was directed at one of the sponsor’s of the annual confab — the über-conservative gay organization GOProud. That sponsorship pissed off many among the legions of culture warriors that attend the increasingly irrelevant annual gathering of gun-toting, Bible-banging, birth-certificate-chasing tea-baggers.

Elsewhere on the web, anti-gay twit Peter LaBarbera of Americans for Truthiness about the ‘Mos has pulled his dirty little mind out of Dan Savage’s sweaty ass-crack long enough to froth lasciviously over the CPAC appearance by Sorba, who, should you care, vice-chairs California Young Americans for Fascism Freedom, co-founded Young Conservatives of California and claims to have a “forth-coming” book entitled The “Born Gay” Hoax.

“I am so proud of this young man,” gushes Porno Pete breathlessly. “We need a few dozen more Ryan Sorbas in our pro-family movement to put the ‘queer’ activists on their heels for a change – instead of constantly being put on the defensive by a perversion lobby that equates sexual misbehavior and gender confusion with ‘civil rights,’” bleats LaBarbera.
